DMCA Policy for Vegetable Stew

Vegetable Stew ("we," "us," or "our") is committed to respecting the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512, we have adopted this policy to address claims of copyright infringement.

This policy outlines the procedures for copyright holders to notify us of alleged infringement and for users to submit counter-notifications when their content has been removed due to a copyright complaint.

Filing a DMCA Copyright Infringement Notice

If you believe that your copyrighted work has been copied and is accessible on the Vegetable Stew website or service in a way that constitutes copyright infringement, you may notify our Designated Copyright Agent by submitting a written DMCA Notice. To be effective, the notification must be a written communication that includes substantially the following:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of the material that you claim is infringing and its location on the Vegetable Stew website or service (e.g., URL of the specific page or post).
  3. Contact information of the complaining party: Your full legal name, mailing address, telephone number, and email address.
  4. Statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy and authority: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Upon receipt of a valid DMCA Notice, we will promptly remove or disable access to the infringing material and take reasonable steps to notify the user who posted the material.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you have the right to submit a Counter-Notification. To be effective, your Counter-Notification must be a written communication that includes substantially the following:

  • Identification of the removed material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled (e.g., URL of the specific page or post).
  • Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number: Your full legal name, mailing address, and telephone number.
  • Statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Vegetable Stew may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature: Your physical or electronic signature.

Upon receipt of a valid Counter-Notification, we will promptly forward a copy to the original complaining party. If the complaining party does not inform us within 10-14 business days that they have filed an action seeking a court order to restrain the user from engaging in infringing activity, we may restore the removed material.
